Man sentenced in sex abuse case

SYCAMORE — A St. Charles man who pleaded guilty to aggravated criminal sexual abuse charges was sentenced to three years in prison Wednesday and faces deportation. 

Jose L. Garcia, 28, of the 200 block of Walnut Street in St. Charles, will be deported to Mexico after he completes his prison sentence because he is not a United States citizen. He must also register as a sex offender for life.

Garcia pleaded guilty to aggravated criminal sexual abusel on May 14, and received the minimum sentence under state guidelines. He could have faced as many as seven years in prison.

On Oct. 28, the family of a Cortland girl who is mentally disabled contacted police to report the abuse. DeKalb County Sheriff's deputies arrested Garcia the same day.

The victim's father – who said he was related to Garcia – was testified at the sentencing hearing. The Daily Chronicle is not printing his name to protect the victim's identity.

In emotional testimony, the father said his daughter has cerebral palsy and needs braces to walk. She also has mental disabilities, he said. Garcia's actions have left him unable to concentrate at work and he lost a lot of time working as a result.

"I feel sad and angry," he said. 

The father also noted his daughter now has a hard time trusting other family members. When he tries to go near her in her bedroom, she'll push him away as if she were afraid, he said. 

He said he would like for Garcia to be kept in prison as long as possible. 

"[Garcia] is a part of my family and I'm going to see him someday and I don't know what I'm going to do," the man said. 

Garcia was received credit for serving 267 days in the DeKalb County jail.
